'equipment' is a fuzzy word, does the lease specifically say that the heater is included in what you are responsible for?
like zephyr said, if you agreed to it when you signed the lease, you may be out of luck, and by you paying to repair it twice before, shows you believed you were responsible for it. but, if you 'fixed' it twice in 2 years, how good could the repair have been?
if you are in a multi-unit building, though, i doubt this would fly in court, because if you didn't get it fixed, do you think that the other tenants would come after YOU to get it fixed???
