Landlord Can Collect Back Rent After Filing MDR

An article, Panel Updates Rules for Recovery of Back Rent in Multiple Dwellings, in the online edition of today's New York Law Journal, discusses the case of 9 Montague Terrace Assoc. v. Feuerer, where the Appellate Term, Second Department, covering Brooklyn, Queens, and Staten Island, has now agreed with the Appellate Term, First Department, covering Manhattan and the Bronx, that a landlord can recover back rent for the period prior to filing a Multiple Dwelling Registration (MDR).

The appellate term held that "upon registering, an owner is entitled to recover the rents which accrued during the period of noncompliance and [an owner] can recover possession based on such nonpayment."
