Appeals? how law works question

Remember that Upper East Side roommate case where the tenant was overcharging the subtenant and the landlord sued for eviction based on the NEW 12/2000 RSC? Last I heard, a Housing Court judge ruled on a motion that it was OK for the landlord to file the lawsuit.

1. Little question: is there an actual decision on this case yet? (what was that name? Ramos?)

2. Real question = if there is a decision on this or another case where the landlord wins based on a new section of the new code, what happens when that new code is thrown out? Does the tenant still have to appeal? Is the case automatically re-opened?
