Yet another MCI increase- for replacing leaky roof?

I've lived in a NY rent stabilised apartment for years..and for years we have been plagued with roof leaks during every rain storm. The landlord replaced the gutter(about 15years ago!) and every now and then the roofers would slap some stuff on the outside walls. None of this worked.After a snowstorm last January, the ice on the roof melted and the leaks were really bad. The landlord finally put in a new roof -but this was the only way to remedy the situation. Now he's applying for an MCI increase to cover his costs. Why does a necessary repair become a "capital improvement"? Is it even worth responding to the DHCR notice?
