Hi. We recently had a situation in our rent-stabilized building where our landlord held a bunch of apartments vacant, then started renting them at "decontrol" rents of more than $2000 per month, and without rent-stabilized leases. A tenant recently went to the DHCR office, and the counselor told them that their rent hadn't been registered in more than 2 years, that the previous tenant had been paying just $1,100, and that since no renovations had been done, the current rent should be "about $1,300 per month." At the same time, the counselor asked the tenant if there had been alot of new tenants in the building, because a bunch of apartments were in the same situation on the DHCR computer, having not been registered in several years.
My questions: Is there a requirement for the LL to register them? Penalties for not registering them? Can the tenants organization in the building make a complaint to the DHCR, or only the individual tenants? Did the LL not register them simply because they didn't want the new tenants to get a copy of the rent registration, showing the previous tenants' rent, and be tipped off to the overcharging?
