he's clearly in or near NYC: DHCR, MCI, duh, only found in RC/RS in NYS.

JJ, Nick, Nick's attorney all agree (duh, because it is the law): no late fee clause in his lease (original lease in RC/RS), no late fee due ever.

ps: no, landlord cannot terminate lease if he's one day late. landlord can send him a 3-day notice to pay and then take him to court.
