LL is using you two as a weapon against the tenant, quite obviously he has no basis/or cause of action on which to evict her; nor does have any intention of renting you 2 the apt, at least not at a rent that would be considered reasonable. Oh, me may give you the primary lease on that apt, with quite a hefty increase. How may apts in the bldg? Your roomate may be rent controlled and it's not at all unusual for rent controlled tenants not to have leases.
You have to ask yourself: what's his motivation? What does he gain?
Any why would he do you any favors?
