No, whichever family member moves into the apartment, that person must actually live ther for 3 years. Then the LL can rent it to someone else.

The subletting issue would only be to circumvent the rent laws. Subletting in that case would be pretty trnasparent-really obvious that LL never intended for a family memeber to occupy the apt.
