roommate overcharge

I was living in a nyc rent stabilized apt up until July (lived there 20 months). The landlord evicted both of us b/c my roommate was overcharging me (as I understand it there is a new law as of 12/00 prohibiting roommates to charge more than their fair share). I was paying her $1000 and -- to my surprise -- the total rent for the apt was only $850. I would like to file a claim in Small Claims to recoup the amount she overcharged me. So, here are my questions:

Rent-gouging roommate now lives upstate NY -- can I still sue her in small claims? Is small claims my best option?
Does anyone know of a similar case where the overcharged roommate won?

Any insight or recommendations would be greatly appreciated.
