There is legislation to protect tenants from having to put up with this, and to allow landlords to evict. In the US I hear it is based on decibel readings and you can hire somebody to come and make some official measurements that are accepted evidence in court. Then you can force the landlord to act, or take the landlord to the rental court. For more info try a Google search on apartment noise laws, etc.
