: I have a month to month rental agreement w/ the woman who sublets my room... the ad said no smoking/no pets... i smoke but never inside...
: when i signed the rental agreement my roommate knew that i smoked but agreed that as long as i didn't smoke in the apt. it wasn't a problem... now i've been given a month to move out because she (an ex-smoker) says having me in the apt. is too much temptation for her...
: Is this legal? I'm going to leave anyway, because she's clearly nuts, and i know it sounds like kind of a petty issue, but i want to know if my eviction is legal...

You are a month to month tenent and you or your roommate can terminate the rental agreement on a 30 days notice.
