Succession Rights and Roommates

Posted by Janice Yuengling on September 10, 2001 at 14:27:33:

I have a friend who wants me to move in and share the rent on her rent-stabilized apartment.

Here is the problem. There is no lease. She moved in 4 and a half years ago as a roommate to the original person on the lease. That person got deported and my friend continued to live there alone for 3+ years. The landlord seemed to have no problem with the arrangement. She has 3+ years of utilities in her name, etc. to prove her occupancy.

Clearly anyone has the right to one roommate if they have a lease and are not overcharging the roommate. However, under the strange circumstances, does my friend need to force these guys to give her a lease and should I move in if she does not have one? Could the landlord evict her because of me?
