It depends, but I believe that landlords of IMD lofts can't offer leases until their spaces are brought up to code anyway. I was lease-less from '83 through '99, when the landlord finally bought me out rather than do the conversions. In the interim, I was technically month-to-month with my rent set by the Loft Board.

Loft law is very murky. I would advise consulting a tenant attorney specializing in loft law about this. If the building is incorporated, as most commercial buildings are, I don't think the landlord can repossess an apartment for personal use. But it's a common scam to get a tenant to move out though. Check back in three months and you find that Junior has moved into another one of the landlord's apartments across town.
