I'm the roommate of the primary tenant--read the whole thread; I don't see where I've used "illusory subtenancy," but obviously that's a mistake if I did. The lawyer didn't say there's no illusory tenancy situation, and that's not what I said; I said that the lawyer claimed there's no way for me to take over the rent-stablized lease based on this situation. Please read the posts more carefully. I've referred to myself as a roommate because that's what I was before the primary tenant left the premises and made me a de-facto subtenant, which is what I'm listed as on the landlord's petition.
