: : I am a Queens resident and a month to month tenant.I am moving on the 10th of this month due to new landlord. Do I have to pay a full month rent? We gave notice last month to the new landlord. And we refuse to live in an apartment upstairs where they are renovating without a permit and doing banging at the walls at 11:30 at night.

I haven't been through this in quite some time but... when my mother died, the LL was so hot to get his hands on her rent control apartment, he gave us a week or ten days to remove her belongings, without charging us rent for the additional time. I don't think he ever returned her security deposit though.

I'd suggest talking to your LL before you go to the Buildings Department or any other city/state agency.
