You have to give 30 days written notice on the date the rent is due. This has to be done on the proper form, and has to be witnessed. If they don't move out by that date, you'll have to file for an eviction from housing court. that could take a couple months.

And if the LL gets wind of all this, your on your own.

: What rights does someone who has been illegally subletting have? No sublease has been signed. Does the prime tenant have to still give 30 days notice before evicting a subletter, even if the subletter has stopped paying rent? Can the subletter be forcibly removed, even with proof that he has been living there for more than a year? This is a non-rent stabilized or controlled apt.
