Common Area Laws for BBQ

Posted by Rad on August 01, 2001 at 22:41:44:

Hi Everyone,

I've recently moved into an apartment in San Diego and ran into some problems I hope someone can help clarify what my options are.

I'm renting a 1 bedroom corner unit from my landlord Debbie and it is a part of a 29 unit apartment complex. This unit is a very unique unit and does not have a patio. The management company sent me a letter stating I cannot have a BBQ grill outside since I do not have my own patio. I do however have a parking area assigned to me and is part of the purchase by Debbie when she made her initial purchase. The management has claim that area to be a "common area" although only myself and two other cars can park there. It has a private gate and assigned parking for each of us. Now they said I can't have a BBQ in common area but no one other than the other two tenants even use the area. What are my options? Am I screwed? I think it's ridiculous. Are there laws out there protecting me? or that makes common sense?

Please help!

Rad
