You have a difficult time ahead for yourself. You must spend min 180 days living in your NY apartment-and the fact that you have a business in Mass is not good(good for you work-wise, not good as far as non-primary residency)Do you work in NY at all? Does anyone live in the apt while you're gone, and how long have you been dividing your time between NYC and Mass? You must prove that this Mass business is not permanent, that you intend to return to living in your apt full time. There is a lot of case law on this subject avail here on tenant.net
