nothing signed, but still refuses to return security deposit

I had planned to rent an apartment, and gave the property manager my security deposit. They do have a sign on the door saying that they do not refund deposits. However, is it still legal to not return it? I DID NOT SIGN ANYTHING saying that I planned to live there, I just gave them the money in case. Also, there was miscommunication within the management group about when I was to have my check deposited, which resulted in they renting out the original apartment that I had asked for. Since they rented my apt, feel that I should get my deposit back, disregarding the sign on the door.
