: I live in a five-story, rent-stabilized Upper West Side walkup. The building's new owner is in the process of renovating about half of the apartments and is causing a long list of headaches for the tenants. My question involves my non-working fireplace. Recently, a
: bird flew down the chimney and into my apartment, so obviously there is no cap at the top of the chimney to prevent this. I have not yet contacted the landlord about this for a number of reasons, but before I do I would like to know if there are any explicit legal provisions dealing with such a situation (i.e., Is he required to cap such a non-working chimney?).
Probably not: find chimney rules in the Building Code, online on the DOB pages of NYC.GOV.
