Illegal sublet?

New York.
A couple of quick questions:
I'm subletting an apartment and am concerned that the subletter has not informed the managing agent/owner. Does this make my lease illegal?
Also, I recently found out that I'm paying $800 a month more than the legally regulated rent. I understand from information received from this website that if the apartment is rent stabilised then it is illegal to charge more than the regulated rent for a sublet. How do I find out whether the apartment is rent-stabilised - I think it is: the building has more than six apartments, was built before 1947, and the subletter moved in after 1971. Am I entitled to get this money back?
