A Supreme Court Justice AND A Co-op Board Member

This interesting item appeared in Today's News Update in the online edition of the July 13th New York Law Journal:

A bitter dispute between a Manhattan co-op board that counts Brooklyn Supreme Court Justice Richard Huttner among its members and the board's restaurant tenant has been ordered transferred to a venue outside the First and Second Department. Manhattan Supreme Court Justice Marilyn Shafer found that given Justice Huttner's active role in prosecuting his co-op's claims in the case, there was "no other way" to avoid the appearance of impropriety but to transfer the case. But Justice Shafer declined to address the restaurant's claim that Justice Huttner's participation in the case violates the state's Code of Judicial Conduct. The fight between the Murray Hill Mews Owners Corp. and El Rio Grande restaurant focuses on whether restaurant patrons should be allowed to drink at a tableless outside bar in an adjacent plaza.
