If you want window guards to be installed quickly, buy them at Home Depot (arond $10 each) and instal them yourself. You have the right to do this. Much faster than trying to go through the city to get them istalled, and the LL would charge you $10 anyways if he installed them.

Regarding your notice to vacate, although going through the eviction process will let you "buy time", I urge you NOT to do this, becuase it will be far more costly then going somewhere else. A "holdover" is considerered ILLEGAL occupancy therefore the landlord can set whatever "use and occupancy" charges he wants. You could get a judgement against you, have to pay the LL's legal fees (as well as your own), and be forced to move on very short notice. You would also find it much more difficult to rent another apartment if you've been evicted.

The landlord's reasons for wanting the apartment back are irrelevant, legally speaking. All he has to do is show that you were a month to month tenant and that he gave you proper notice to leave. As for housing violations in a holdover, bring them up and you are only showing the judge all the more reason why you should leave.

Do your family a favor and find a better apartment, soon.
