First of all,, not rent stabilized, the new roommate law doesn't apply. If your roommate, who is the prime tenant, has no lease with the LL, then what kind of lease are YOU signing? Since your roommate has no lease with the LL, then its a month-to-month tenancy. If you sign a lease(or a roommate agreement) between you and your roommate, for a term of more than 30 days, it's worthless, because he has no lease to begin with! As far as recovering the money, are you going to be staying in that apartment?
