deceased landlord

This is an acutal tenant/landlord fact-situation in Brooklyn NY of an aquaintance of mine. Landlord passes away several months ago. Lease was verbal and negotiated through a broker. Landlord's son appears on the property, but mentions nothing about to whom or where rent should be paid. Tenant has not paid rent for several months because tenant is confused about whether landlord's son has a legal right to collect rent. Certainly, there could be grounds for eviction, but why has that not occurred for three months worth in arrears?

Might there be a reason why the landlord's son has not asked for rent payment? Landlord's son and tenant have good relations with each other and do see each other on the property from time to time. In fact, landlord's son is tenant's neighbor in another unit on the same street. Why hasn't he inquired about the arrears when several months have passed? Could there be a real property issue that prohibits him from legally aquiring rent?
