paying lawyer instead of landlord

I think it's going too far to say never use withheld rent money to pay an attorney. It depends on a lot of things: how strong the case is, the tenant's finances, the tenant's comfort with risk, whether the judge requires that rent be paid into escrow, etc. etc. etc. It's not ideal, but some tenants might not be able to afford a lawyer at all unless they use some of the unpaid rent. And for some cases, the tenant might not need a lawyer. Though obviously, the tenant shouldn't go out and blow it on other things...
