Your lease states the terms... 5 days late penalty, etc.

The terms of the lease when it was signed and agreed upon states the conditions of the agreement. Nothing can be introduced after until the end of the lease.

My landlord tried to charge me late fees sometime ago and I stated that my lease didn't state a penalty fee and/or any charges... To say the least I never paid him late fees (but of course I paid on time to avoid any issues) and the landlord couldn't bring up any issues regarding late fee (of course when I was slow to pay the rent, he/she was slow to make repairs... Get it?)

: If it's in your original lease, yes they can.
