NYC rent stab tenant. It's more than 3 years since I had my apt. painted. It's time a new paint job, have asked LL in writing twice and sent the letter together w/my rent check. Checks have been cashed, so LL received my requests. In the 1st letter I just asked for the paint job. On the 2nd letter I asked once again for the paint job and told LL that if I did not hear back from him by the end of the month, he has given his tacit consent for me to hire my own painter and deduct the cost from my rent.
I just sent him this month rent check w/another letter saying that as he has not responded to my request to have the apartment painted, I now have his irrevocable consent to paint the apt. and deduct the cost from my rent.
My question is: When I deduct the cost of the paint job from my rent, if the LL decides to take me to court, what are my chances of prevailing?
