It's my understanding that if you paid a fee in anticipation of getting an apartment thru that broker and you do not, thru no fault of you own, get the apartment, the brokers fee is not due and owing, unless you signed something that says the fee is paid not matter if you get the apt or not. It costs very little to file in small claims court, so do it anyway!
