One way for a LL to evict is if tenants are using the apt for illegal activities and/or creating or permitting a nuisance. Tony is doing all of the above. Unfortunately, you and your fiance are also on the lease and have some liability. I would suggest another talk with Tony, and, believe it or not, call his parents, if they give a da__.
A prime way to cover you a__ is to put this in writing, send it to Tony certified mail or Fed-Ex when you know he'll be home to receive it. In writing puts him on notice and covers you, as best as you can be covered in this situation.
