No, No,No! No 30 day notice- BS! Sawbones doesn't have to go anywhere! Sawbones signed a lease! He/she does not have to move, period, until the end of the lease (should LL elect not to renew the lease or Sawbones elects not to renew). But, as you said, the smoking may be an issue, but I haven't heard that a no smoking clause in a residential apt is enforceable in NY? Is it? If Sawbones pays the rent and doesn't smoke in the apt or the bldg, then she/he is good for the remainder of the lease term, if not beyond.
