i think a lot of us understand where you're coming from (i've had my share of doozy roommates). before going ahead with legal proceedings, i'd sit down and explain what you plan to do, and that the law is more or less on your side here. he obiously doesn't believe you will really go through with this, but if he sees you following through, i bet he'll get his act together.
