NO lease, lower east side

Can someone tell me this....is it illegal to live in an apartment in manhattan without a lease? my landlord never gave me a copy to sign, always putting me off each time i went into the office, telling me that the lease was "in the brooklyn office, we'll send it over to you..."

it never came. i went back, he said, "well slide it under your door tomorrow"

months passed...

again, it never showed up. things happen, i should have pressed him more, but i didn't, just let it slide...UNTIL today...

he just told me today that i'm SUBleasing, and might have to move out in a month. i asked him for a copy of the lease, he said " you never signed a lease". i told him that i was never given a lease and he said it was "equally" our faults.

now, i ask him again to send me the lease and he stumbles...."i'll type it up for you... i can just BACK date it." then i interupted and said, "i thought it was in the brooklyn office..."

he stumbled again, "sure, it's there, come in tomorrow, i'll have it."

any input on this???
