Roommate trying to evict me and move her sister in

Posted by sheababylv on March 23, 2001 at 04:20:33:

I live in a 2-bedroom, non-stabilized, Brooklyn apt. Both my name and my rooommate's name is on the lease and all rent and bills are split equally. Our lease is up on May 1st and she just told me a few days ago that she doesn't want to live with me and that I have to move. She told me she would get the apartment if we both went for it because she makes more money than me. She then went to the landlord and told him that I wouldn't be renewing and she and her sister would be. I've told him that I want to renew with or without her. I know she can't really evict me, but my specific question is: If she wants the apartment with her sister, and I want the apartment and also have another roommate ready (I don't meet the income requirement alone), who gets the apartment? What criteria will be used to decide what to do, and what are my legal rights? Will we both just be asked to leave?
