It is, of course, not legal to discriminate on the basis of familial status, if that is your question. However, many states/localities have laws limiting the number of occupants on the basis of square footage. This complex's "policy" may derive from that law, but it may also derive from the LLs concern that a higher number of occupants will result in increased utility (especially water) bills and greater wear and tear. Try to find your local and state codes to find out if their policy is consistent w/the law.
