What are my rights when I sublet?

Posted by Joe Landauer on March 01, 2001 at 16:38:26:

Manhattan, Lower East Side, Stabilized. 25 apartments in an old tenament (early 1900's).

I am working freelance out of town and my job has extended to about 9 mo's away from NYC. I have been sub-letting to a friend at no extra cost on top of my NYC rent. We got a letter from our landlords attorney saying my friend had to be out in 15 days or we would lose our lease. Do we have a right to sublet to him while we're away if it is under a year and we are not charging any more than our regular rent? Can he be kicked out?
