pro-rated rent

Recently, my friends and I had our rental applications accepted to rent an apartment. We wanted to move in on the first of February, but the landlord didn't have the apartment ready until the 9th. We were told to come by the 9th with our $$ to sign a rental agreement and then we could move in the 10th. We had agreed verbally on pro-rated rent for the month because we could not move in on the first. However, when we arrived to pay our agreed deposit and rent, the landlord said it's not enough $ and now wants a full first months rent. Is this legal? Apartments are very scarce at this low rate, so we don't want to miss it and we all need to move! We are in California, by the way. There are 10 units is the building.
