You don't say where you are from. It all depends where you live. Also, damages can be construed as to mean that he had to go to his PO Box more times or call to see where rent is, finance charge on his debts, ..... see what I mean it is all so subjective. I saw one landlord who charged an exhorbitant late fee win in court because he charged for his time, mileage, damage to his personal credit because it affected his timely payment of debts associated with the home!!! If the rent is due on the 1st, even credit card companies tell you to allow 5 days for mailing meaning that it should be sent on the 25th if due on the 1st. Due on the 1st does not mean mailed on the first. The grace period is meant for problems with mailing.

Check your cancelled check and see when it was deposited. That may provide additional clues.
