the landlord could decide that the current lease is to have the three of you only and once it ends, he could ask for the three of you to go.

it sounds like a sticky situation as to who has more "right" to the apartment. did you all three rent it at the same time or did one person find it and you moved in after?

If you really can't get along with that roommate that wants to stay, I say move yourself out. Save yourself the headache.

: i am renting a 3 bedroom apt. in westchester with two other people. our lease it up this summer, and already roommate #2 is planning on moving out. i want to stay, but not with roommate #3. how can we decide who gets to keep the apt? should we leave it up to the landlord?
