You have a good chance of getting a lease in that you already live in the apartment. You will have to pay a much higher rent however. 18-20% vacancy increase plus 4 or 6% for a 1 or 2 year lease. It could be more if the LL argues that LL intends to totally renovate apt and thus could get more rent than LL can now legally charge you for a vacancy lease. Once you're in court it is entirely feasible for you stipulate (agree to) a rent that is higher than what you would pay on a vancancy lease. It all depends upon how much you want this apartment because it's going to cost you legal fees + much higer rent.

As for all the facts: you're an illegal subtenant plain and simple, and you're going to have to fight for the apartment. I believe you will get it, if you're willing to pay much more money.
