It really doesn't matter whether this is a coop sublet (which it is) or any other type of rental arrangement. The only thing that does matter are the terms of the deposit.

You stated that the check merely says 'deposit'. Is there anything elsewhere (maybe on the application?) which defines the terms of the deposit, such as 'refundable', 'non-refundable', 'refundable only if not approved by the board', etc. If there is nothing in writing, then it will be your word against theirs in Small Claims Court.

You can also search here and on the homepage of Tenant.Net for deposit information. Deposits are the realm of the Attornay General of the State of NY.
