Unfortunately, it is legal in most states and is becoming a more common provision of leases. Different places handle it in different ways. Some have the tenant pay first $50 - $100 others hold tenant completely responsible.

Look for it in future leases. You CAN negotiate the terms of a lease PRIOR to signing. Once you've signed it, you are bound by the terms of the contract.
