He can't pass along the 1/40th rent increase unless the tenant agrees. RS tenants have a right to a working refrigerator comparable (in size and features) to the old one. If the LL can't find a used working model, he must still provide one that works, even if it is new.

: If you are rent stabilized, your options are more limited. The landlord is required to supply you with a working refrigerator but not a spiffy, frost-free modern one. You can request that he replace yours. He can pass along 1/40 of its cost to you as a monthly rent increase. Otherwise he is required to replace the fridge only if it breaks, and even then could replace it with a used model.
