Definitely sue. You've done a nice of documenting your claims. You might be entitled to treble damages--better research that one--but then again, you may be up against the jurisdictional limits of the small claims court.

Keep it simple--he hasn't given you back your money. Money for painting? No way. Offer to show your videotape if he puts up any kind of defense. (I wouldn't mention it until after he has presented his case.)
I dont see the point of subpoenaing that real estate agent.

If this is NYC, you have the option of a mediator. Definitely go for it--it is basically the same as a judge, except you cant appeal.
