In NYC if a landlord wants to evict for nonpayment he must give 3 day notice to the tenant, then can commence court proceedings. There is no three month waiting period (I doubt many landlords would be in business if there was).

Of course if this case goes to court it may take three or more months to resolve, but you'd probably have to deposit rent with the court during that period.

Try to work something out with your landlord, perhaps making arrangements to pay what you can now and the rest on a schedule. Alternatively, get a cheaper apartment or perhaps a new roommate pronto so that you will have the cash flow to afford your space.
