First, Real Property Law section 235 specifies the rights to having roommates, and this is independent of any rent regulation. Overcrowding is a function of Building and Fire regulations, which are local laws, not state laws.

Richard, you're treading thin water again. Tenants do not need to be lectured. This is why you've been suspended twice now. The question was about roommates, not the tenant's economic plight (if any). The tenant inquired about rights, not whether the exercise of those rights would be "stirring up trouble." The right to have roommates has nothing to do with the tenants' circumstances. The law was enacted to remove issues of circumstances from the equation -- if you bothered to read instead of react, you might know this. We're tired of your lecturing without any factual basis, so keep it up and you may be off for a longer period.

: If you have a cheap rent controlled apartment, why cant you afford the rent yourself? Why not get a second JOB?
: The LAST thing you want to do is stir up trouble, and having the landlord try and evict you.....
: IF you have some very legitimate reason for wanting more roomates.....like you are disabled and need a live in care taker.......that would be a good defense.
: BUT to try and make a profit on your cheap apartment......i would hope the landlord would try and evict you.
