Hi, my name is Carol. I live in a cooperative in Westchester County. I have been having a problem with managing agent for sometime now. My current problem is as follows:
The bldg. was recently assessed with 6-month assessment charge to replace new boiler. Our maintenance is due from the 1st to 5th of month. After the 5th of month they charge a $25 late fee. After the 10th of month they charge a $50 late fee.
I always pay my maintenance on the last day of the prior month or 1st or 2nd day of current month via "certificate of mailing" via post office as proof of payment of same.
I pay the new assessment on the 3rd thru 5th of month because I do not have all the monies available at sametime.
The managing agent is an man with all sorts of "dirty tricks" up his sleeve. I sent maintenance at 1st of month and he returned maintenance on 4th of month stating since I did not send assessment at sametime in same check he is returning my maintenance and he will charge me a $50 late fee if maintenance and assessment are not received by him by 5th of month. What can I do?
The prior problem I had with agent was that he has tried to blame me for water damage to apartments beneath me, I live on top floor, claiming my shower caused water damage to all 6 floors beneath me. I finally resolved same by bringing in the town building inspector to inspect my bathroom and he wrote report to stop the harrassement by managing agent.
Please advise. I believe that he is trying to build up some sort of case to evict me from cooperative for non-payment of maintenance.
