We'd like to say welcome back, but your first post out gives absolutely stupid advice. You have no idea what this LL will do, and to tell the tenant to accept capital improvements with a 1/40th increase in rent masquerading as repairs is to tell the tenant to ignore their rights. These are repairs and required even if the rent was $10 per month. The tenant can a) start a HP action (after his time runs out), b) withhold rent again, or c) ask for a contempt citation or have the case restored to the calendar. It all depends on the facts of the case. Richard, if you can't be helpful, we'll bid you adieu again.

: The landlord WILL harass you from NOW till he dies......because you are paying $400 a month rent......and if he does it this way by NOT threating you, then its legal..... and YOU will have to keep taking him to court to get things fixed.

: DID you get a lease in your name for $400 a month or did the judge just dismiss the case?.....The landlord might try again to evict you if it was just dismissed.

: EG..DO NOT EVER PAY YOUR EXTREMLY LOW RENT LATE........or he will try and evict you again!

: BUT ALSO the Landlord is RIGHT.......if you really want things fixed AND you want to repair the damage caused by this lawsuit AND you want the landlord to stop harassing you....

: Then AGREE to pay for ALL the repairs at the LEGAL increase of 1/40 of the cost per month.

: If he does $4000 worth of repairs your rent will go up $100 per month forever.

: This is a case of common sense.....agree to pay extra rent for no more harassment from the landlord.......you both will be far better off then to sue and make it even worse!

The court said that he has a certain time to do it. Now he passed those times. When does this become criminal? The court has started fines against him. However, how do we know if he has to pay or not? Can he get arrested for this? Should we retain our Real Estate lawyer again or is there a different type of lawyer we need? Please help!
