Invalid Certificate of Occupancy:MDL Violation?

Building is classified as Class B SRO Hotel, with last CO at DOB from 1957 stating 377 rooms...DHCR records state LL registers 428, and for 2000, 482.
HPD Violations Report Summary states 377 units for same year! (this is with their annual inspection).
If LL's actions in Housing Court and PAR with DHCR have been done under fraudulent circumstances or misrepresentation (namely, stating that he is conformance with applicable ETPA and rent regs) what options does a tenant have?
