Why a second posting? It wasn't necessary.
The original answer was very comprehensive. However I dont believe a backyard would be considered de minimis. Those awful new DHCR rules, which are not yet in effect, would make reduction in services complaints much harder, and specifically exempt "de minimis" things, so I suggest you file your complaint fairly soon.
